General Sales and Use Terms
None of the conditions below is meant to affect or reduce your rights.
These general sales terms are available at any point and systematically brought to the awareness of each client/user in order to allow them to order. Thus, the act of ordering and checking the “I accept the general sales terms” box during the payment process implies a full agreement with no conditions on the part of the client to these general sales terms.
CONCEPTS
Escape Prod is a live action escape game concept which belongs to the Escape Prod SPRL company. These current general sales terms are applicable to any contract for the use of a game room made between any company of the Escape Prod SPRL group and the users of the room (called “users”), whether they reserved personally or they are a part of the team of the person who made the reservation (called “purchaser”). These conditions are generally applied no matter the reservation method, whether made via the Escape Prod SPRL website (escapeprod.com), or with a member of the Escape Prod SPRL staff.
The game space made available to the players is called the “room”, and "bag" for the outdoor games. The game for which the purchaser reserves and pays on the website is called the “game session”.
Escape Prod SPRL recognizes the right to modify or have modified all or part of these general sales terms as well as the contents of its website, to its sole discretion, at any time, and with no forewarning.
The general sales conditions of Escape Prod SPRL are available on the website and can be consulted freely by simply asking the greeting staff of Escape Prod SPRL.
BOOKING
Reservation process
The use of a room is subject to a reservation and proper payment. This is made by the purchaser on the Escape Prod SPRL website: escapeprod.com or with a staff member of Escape Prod in their offices.
The purchaser must have a valid e-mail address to be able to reserve.
The reservation is definitive after the reception of the reservation confirmation e-mail, which is sent to the purchaser at the end of the payment process.
The staff of Escape Prod SPRL can make the reservation in the purchaser’s name, by going through the Escape Prod website. In that case, the purchaser agrees with no conditions that this type of reservation implies no responsibility on the part of Escape Prod SPRL or of its staff, as the staff is then only acting as data entry for the instructions given by the purchaser. The purchaser thus gives up any recourse from a breach of the confidentiality of their data, or of a fraudulent use of their account.
Escape Prod SPRL reserves the rights to refuse any reservation for a PURCHASER who has not have paid all of the fees billed to them.
Reservation less than 24h before the game session
To make a reservation less than 24 hours before the game session, the purchaser must contact the staff of Escape Prod SPRL in their offices or by phone, or e-mail, or via contact form.
The reservation will then be made by the staff of Escape Prod and the payment must be made on location before the start of the game session.
Payment method
Only payments by bank card are accepted on the website. If the purchaser cannot pay the amount of the reservation via bank card, they must first inform the Escape Prod SPRL staff and be present at the front desk on the day of the reservation in order to pay the amount in euros by check, credit card, or cash (in euros).
Online payment
Escape Prod SPRL has given the management of its online payment platform to a third party specialized in the securing of online transactions. Said third party keeps no data regarding the purchaser in their database.
The website is available in French, Flemish, and English. However, in case of dispute, only the French version of the website and of the general sales terms may be opposed to Escape Prod SPRL.
Reservation transfert
A reservation cannot be transferred or resold for commercial purposes. If a reservation is transferred or resold in violation to this article, the bearer of said reservation will be refused access.
Schedule and lateness
Escape Prod asks the users to be present in their offices on the day of the reservation 10 minutes before the start of the game session.
In case of lateness of part of the users for a reserved session, the present users may decide whether or not to start the game.
In any case, the room must be vacated at the time originally planned for in the initial reservation.
Escape Prod SPRL reserves the rights to refuse access to users who are 15 or more minutes late.
The schedules will be automatically reprinted in the confirmation e-mails sent by Escape Prod SPRL.
Withdrawal and refund
No reservation may be cancelled or reimbursed except in the case of a cancellation due to Escape Prod SPRL. In that case, the amount of the original reservation will be refunded.
PERSONAL DATA
The purchaser is responsible for the correctness of the data entered on the online reservation form on the website.
The purchaser agrees to receive, on behalf of Escape Prod SPRL information and promotional offers on their e-mail address or on their cell phone by clicking on the authorization box of the website.
The purchaser and/or user who enters their phone data on the Escape Prod SPRL website agrees to be contacted by Escape Prod SPRL via phone or SMS.
The purchaser entering the data of the other users (family and first names, phone numbers, e-mail addresses) authorizes Escape Prod SPRL to send information and promotional offers to these users..
Escape Prod SPRL agrees not to transmit the personal data of its users to a company external to the Escape Prod SPRL group, unless requested by an authority allowed by law, and within a legal valid framework.
AVAILABILITY AND USE OF THE ROOM
According to the very principle of the game, Escape Prod SPRL grants the users the right to occupy the room for a period of sixty minutes. The occupation of the room is for the sole purpose of participating in a game organized by Escape Prod SPRL, which must be made as a team made up of a number of players as specified on the website, and which may vary from one room to the next.
Length of the game
The users agree that the duration of their presence in the room will be of a maximum of 60 minutes, whether they’ve managed to finish the game or not.
The users agree that the duration of their use of the bag will be of a maximum of 90 minutes, whether they’ve managed to finish the game or not.
The users agree that the game ends before the end of the 60 minutes if they’ve reached the end of the game in less than 60 or 90 minutes without it being the object of an adjustment of some sort, or monetary compensation.
Admission to the room is only possible upon presentation of the reservation confirmation email (sent shortly after the payment process to the purchaser) and upon presentation of a photo ID by said purchaser.
Age of users
The users must be a minimum of 8 years of age for "the Dalton's Escape", 10 years old for "Mission Museum" and "Escape the City", 12 years old for "Blacksad - Private Detective".
The minor users aged less than 16 must be accompanied by at least one adult aged over 18.
Escape Prod SPRL reserves the right to ask for a proof of age.
Use of the contents of the rooms and the bags
The users are expected to keep the room or the bag and all of its equipment (non-restrictive list: decorations, furniture, accessories, etc.) in good condition and to use it according to the authorized use. In accordance with this, the user recognizes that by accepting the present usage conditions that any intentional degradation or caused by an unauthorized handling of the room and of its equipment will be cause for surcharge fees of an amount determined by Escape Prod SPRL.
In addition, the user is expected to use the room or the bag and its equipment in a way to not cause, or risk causing, any damage to the other users, to the offices and equipment of Escape Prod SPRL.
Behavior and know-how
For their entire presence in the offices of Escape Prod SPRL, the user engages themselves in behaving in a respectable way, to conform to the rules, and to cooperate with the staff of Escape Prod SPRL.
Escape Prod SPRL tolerates no form of violence, whether verbal or physical, in the form of harassment or intimidation, against its staff or other users, and thus reserves the right to refuse access to the offices to anyone whose behavior is akin to the previously listed elements.
Escape Prod SPRL also reserves the right to refuse access to anyone under the influence of alcohol or drugs.
For any of the conditions listed above, being barred access grants no indemnity or reimbursement.
Confidentiality of the contents of the rooms
No recording can be made in the room. This, the use of video and/or audio recording equipment (non-exhaustive list: mobile phones, cameras, go-pro, tape recorder...) is formally forbidden. Any use of this type of device may cause the game to stop completely for the entire team.
Escape Prod SPRL expects of its users that they do not disclose the details of the game in a direct and/or indirect way. Any partial or total disclosure would violate the commercial interests of Escape Prod SPRL.
SECURITY
The user agrees to respect and security measures given to them, whether contractual, posted on site, or given verbally by the staff of Escape Prod SPRL.
It is formally and strictly forbidden to smoke inside of the Escape Prod SPRL offices.
Emergency exits
Each user agrees to be aware and respect the security and fire safety protocols, as well as the emergency exits. These are clearly identified in the offices of Escape Prod SPRL.
It is forbidden to block the emergency exits, which must remain clear under all circumstances. The user will be able to use the emergency exits if, and only if, the situation requires the evacuation of the office (for example, due to a fire). Any abuse and/or unnecessary opening of these exits by a user will be cause for extra billing of the costs caused by this abuse to the user.
Forbidden items
The user is aware that it is strictly forbidden to bring to the offices of Escape Prod SPRL items considered to be physical hazards (explosives, inflammables, sharp, fuel, pressurized or liquid gas, corrosives...), hazardous to health (toxic, corrosive to the skin, irritant/sensitivity-inducing, cancerogenic/teratogen...), dangerous to aquatic lands and any item which could be considered a weapon, even if possessed along with a legal license.
PRICE
Rates for the rooms
The prices charged by Escape Prod SPRL are provided on the website (rates page) and are also posted in the offices of Escape Prod SPRL. They are displayed in euros (€) with all taxes included and by person, for a game session of a maximum of sixty minutes. The price per person is fixed according to the number of participants in a given team. The fees decrease and evolve as follows:
- forty four euros if the team is made up of 2 people
thirty euros per person if the team is made up of 3 people
twenty-five euros per person if the team is made up of 4 people
twenty-two euros per person if the team is made up of 5 people.
- twenty euros per person if the team is made up of 6 people.
Any other group will be the cause for additional billing.
Escape Prod SPRL reserves the right to modify its fees at any time. Any purchaser will pay the amount relative to the rate used at the moment of the reservation.
Rates for the bags
The prices charged by Escape Prod SPRL are provided on the website (rates page) and are also posted in the offices of Escape Prod SPRL. They are displayed in euros (€) with all taxes included and by person, for a game session of a maximum of sixty minutes. The price per person depends on the age of the users.
Escape Prod SPRL reserves the right to modify its fees at any time. Any purchaser will pay the amount relative to the rate used at the moment of the reservation.
Change in the number of users
If fewer users are present to participate in the game session than were originally planned for during the reservation, the purchaser and/or the users cannot claim a reimbursement of the price difference.
If more users are present to participate in the game session than what was originally planned for during the reservation, the price difference must be settled before being able to participate in the game, within the limit of 6 allowed users per room or bag.
PHOTOS AND CAMERAS
Photos of each team of users may be taken before or after the game session, with the agreement of the users appearing on the pictures. These pictures may be used by Escape Prod SPRL in order to be displayed on its website or its digital ecosystem (such as Facebook, Twitter, Instagram, etc.).
Escape Prod SPRL may not be held responsible for the use which may be made of the photos by the users and/or the purchaser.
Each room contains a video surveillance and listening unit allowing the staff of Escape Prod SPRL to follow the game session and give hints to the users if needed. This unit is only used for the game and does not record the users game sessions.
COMPETENT TRIBUNALS
The present general terms and any contract concluded incorporating these terms and conditions are regulated by Belgian lay and any litigious is subject to the exclusive competence of Belgian tribunals.
